Terms of use and sale
Last updated: [publication date]
Excessive drinking is dangerous to your health. Please drink responsibly.
1. Who We Are
The Grena application (“the app,” “the service”) is published by [company name], a [legal form] with share capital of [amount], registered with the RCS of [city] under number [SIREN], EU VAT number [number], with its registered office at [address] (“Grena,” “we”).
- Publication director: [name].
- Contact: [email address] — [postal address].
- Data hosting: [Supabase, exact company name and address of the contracting entity, to be taken from the Supabase contract], on servers located in [project region].
2. Purpose and Acceptance
These general terms and conditions (“these Terms”) set out the rules for using Grena and, for the Premium subscription, the terms of sale. They apply to anyone who uses the app (“you”).
By using Grena, you accept these Terms and the Privacy Policy, which explains how we process your data. If you do not accept them, do not use the app.
These Terms apply in addition to the terms of Apple’s App Store or Google Play, through which you obtained the app.
3. Conditions for Accessing the Service
Age. Grena is reserved for adults who are of legal age to purchase and consume alcohol in their country of residence. By using the app, you represent that you meet this requirement.
Personal use. Grena is intended for personal, non-commercial use: managing your own cellar. For professional use (wine merchant, restaurant, wine resale), please contact us.
Equipment. Grena runs on a recent phone using iOS or Android, with the operating system versions indicated on the app’s page in the stores. Some features require an internet connection (scanning, pairings, wine suggestions, sync, subscription); your cellar can still be viewed offline. Connection charges are your responsibility.
No sale of alcohol. Grena does not sell alcohol and does not promote it. Information about wines is provided as information and personal guidance.
4. Your Account
Guest account. The first time you open the app, Grena creates a guest account without asking you for anything. With a guest account, your data stays only on your phone: it is not backed up and will be lost if you lose, change, or reset your phone, or if you uninstall the app.
Creating your account. To back up your cellar and access it on another device, create your account with your email address: you will receive a 6-digit code to enter in the app. There is no password. Your guest cellar is attached to your account, so nothing is lost.
Your commitments. You agree to use a valid email address that belongs to you and to keep access to that address: it is the only way to sign in. You are responsible for what is done from your account. Notify us without delay if you believe someone else is using it instead of you.
One account per person. Your account is personal. You may not transfer or share it.
5. Account Sync
When you have an account, your cellar (cellars, wines, bottles, wish list, notes, profile) is backed up on our servers and synced. On the free plan, one phone at a time is synced: you can switch phones at any time, and the previous one then stops syncing. With Premium, all your devices are synced.
- Changes are sent a few seconds after they are made. When you are offline, they wait on the phone and are sent once the network is back.
- If the same item is changed on two devices, the most recent change prevails.
- If you sign in to your account on a phone that already contains a cellar, the app asks whether to add it to your account, replace it with the account’s cellar, or cancel signing in.
- If you sign out, your cellar is erased from the phone and remains on your account. Changes that could not be sent before you signed out (for example, with no network) are lost.
We do what is necessary to preserve your data, but we recommend that you export your cellar regularly (Profile › Export my cellar).
6. Features: Free Plan and Premium
Grena offers a free plan and a Premium subscription. The exact content of each plan is shown in the app, on the Premium screen, when you make your choice.

The free scans are offered once, at installation, and are used before the monthly ones; creating your account adds more. Unused monthly scans do not carry over.
If your subscription ends, you keep access to everything you have already created: nothing is deleted. Only additions beyond the free limits and Premium features are no longer available.
We may change the features (see Section 14). We will not remove an essential Premium feature during a current subscription period without informing you and allowing you to cancel.
7. The Grena Database and the Information Provided
What the database contains. Grena relies on a database of wines, estates, appellations, grape varieties, dishes, and pairings compiled by Grena (“the Grena database”).
Indicative information. Wine pages, peak drinking periods, maturity levels, serving temperatures and advice, food and wine pairings, wine suggestions, and scan results are indicative, prepared with care from sources we consider reliable. They may be incomplete or inaccurate, and they do not replace your own judgment or the advice of a professional. Label recognition can be wrong: check the suggested wine before adding it.
Bottle photos. When the Grena database has no photo for a wine’s vintage, the app may show the photo of another vintage of the same wine. That vintage’s label may differ slightly from the one on your bottle.
Prices. Grena does not display retail prices for wines. The purchase price you enter is yours, and the resulting cellar value is only a personal estimate; it does not constitute an appraisal or financial advice.
Protection of the database. The Grena database is protected by copyright and by the database producer’s right (Articles L. 341-1 et seq. of the French Intellectual Property Code and Directive 96/9/EC). Without our written consent, it is prohibited to extract or reuse a substantial part of it, or insubstantial parts on a repeated and systematic basis, in particular by means of bots, scripts, or automated querying of our servers, in order to build a competing database, use it for commercial purposes, or train an artificial intelligence system.
8. Your Content
It belongs to you. The cellars, notes, comments, wish list items, and other content you enter remain yours. You authorize us to host, copy, and transmit them between your devices, solely to provide you with the service, and for the lifetime of your account.
What you must not do. Your content must not be unlawful, infringe the rights of others, or contain sensitive data about other people. Your content is private: Grena does not publish it or show it to anyone.
9. Photos Submitted to Enrich the Database
Label scanning takes place on your phone: the photo is not sent to us (see the Privacy Policy).
If the app offers you the option to send us a label photo (for example, to report a missing wine or an incomplete wine page), and you choose to do so:
- you grant us, free of charge and on a non-exclusive basis, worldwide and for the full term of the rights, the right to reproduce, adapt (crop, cut out, correct), display, and incorporate this photo into the Grena database, in order to recognize labels and illustrate wine pages in the app and in its presentation materials;
- you represent that you took the photo yourself, or hold the necessary rights, and that it shows no person and no personal information;
- the photo is not associated with your name or your account in the Grena database;
- you may ask us to remove it from the database in the future by writing to us. Removal does not apply to copies already incorporated into versions of the app distributed before your request.
The label itself remains the property of its producer: this license covers only the rights you hold in the photo.
10. Grena’s Intellectual Property
The app, its name, logo, texts, illustrations, icons, layouts, code, and the Grena database are the property of Grena or its partners and are protected by intellectual property law.
We grant you a personal, non-exclusive, non-transferable, and revocable right to use the app on the devices you use, for your personal use and in accordance with these Terms. In particular, you may not copy, modify, or decompile the app (except where permitted by law), circumvent its limits or protection measures, or use it to create a competing service.
Trademarks, domain names, and wine labels belong to their respective owners.
11. The Premium Subscription
11.1 Plans and Prices
Premium is an automatically renewing subscription, offered in two plans:
- monthly: €4.99 per month;
- annual: €49.99 per year.
The prices shown are those for France, including all taxes. In other countries, the applicable price, in your currency and including local taxes, is the one displayed by the App Store or Google Play at the time of purchase. We may change our prices: a new price does not apply to a period already paid for, and the store notifies you before a renewal at a higher price, asking for your consent where the law or its rules require it.
11.2 Purchase
The subscription is purchased in the app, through the App Store or Google Play, using the payment method registered to your Apple or Google account. The sales contract is concluded when the store confirms the purchase. Payment, billing, and VAT are handled by Apple or Google, under their terms. Premium is activated immediately on your Grena account and follows you to your other devices signed in to the same account.
11.3 Free Trial
A free trial of 7 days may be offered, once per person, on the annual plan. Its length and the price charged afterward are displayed before you subscribe. At the end of the trial, the subscription automatically becomes paid, unless you cancel it at least 24 hours before the trial ends. If you cancel during the trial, you will not be charged. If you have allowed it, the app reminds you with a notification 2 days before the trial ends; the day before, it shows you a summary of the trial and the amount that will be charged.
11.4 Automatic Renewal
The subscription renews automatically at the end of each period (month or year), for the same duration and at the price then in effect, and the amount is charged by the store within the 24 hours before the end of the current period, unless you have canceled at least 24 hours before that date.
11.5 Cancellation
You can cancel at any time in your store settings (not in Grena):
- iPhone: Settings › [your name] › Subscriptions › Grena;
- Android: Google Play › Profile › Payments & subscriptions › Subscriptions › Grena.
The app takes you there from Profile › Manage subscription. Canceling stops the next renewal: Premium remains active until the end of the period already paid for. Deleting the app or your Grena account does not cancel the subscription.
11.6 Refunds
Since payments are collected by Apple or Google, refund requests must be made to them, under their terms:
- Apple: reportaproblem.apple.com;
- Google: the order page in Google Play.
A subscription period that has begun is not refunded by Grena on a pro rata basis, unless required by applicable law or in the event of a prolonged unavailability of the service attributable to us.
11.7 Right of Withdrawal
If you are a consumer residing in the European Union, you have, in principle, a 14-day period from the purchase to withdraw, without having to give any reason (Articles L. 221-18 et seq. of the French Consumer Code).
Premium gives immediate access to a digital service. By subscribing, you expressly request that the service begin immediately, before the end of the withdrawal period. If you then withdraw, an amount proportionate to the service already provided may remain payable (Article L. 221-25). Where the law permits it for digital content supplied immediately, you acknowledge that you lose your right of withdrawal (Article L. 221-28, 13°).
The right of withdrawal is exercised with Apple or Google, which collect the payment (see Section 11.6). You can also write to us at [email address]: we will help you with the process.
Outside the European Union, the rules of your country and of the store apply.
11.8 Restoring a Purchase
After reinstalling the app or changing phones, Profile › Restore my purchases retrieves the subscription purchased with the same Apple or Google account.
12. Availability, Maintenance, and Technical Incidents
We do our best to keep Grena available at all times, but we cannot guarantee it: the app depends on the internet, our service providers, and the stores.
- Maintenance. We may suspend the service for maintenance or an update, scheduling it during low-usage hours where possible and notifying you in advance when it is lengthy.
- Incidents. In the event of an outage or a security incident, we act as quickly as possible to restore the service and protect your data, and we inform you if the incident concerns you.
- Offline. Your cellar can still be viewed and edited without a connection. Scanning, pairings, wine suggestions, sync, and the subscription require a connection.
13. Updates
We release updates to fix errors, improve security, or add features. Some may be necessary to keep using the service or sync. If you are a consumer in the European Union, we provide the updates necessary to keep the app in conformity for the duration of your subscription (Article L. 224-25-25 of the French Consumer Code). If you do not install a necessary update, we are not liable for the resulting defect.
14. Changes to the Service and to These Terms
We may change Grena and these Terms, in particular to comply with the law, store rules, or changes to the app. The version in effect is always available in the app (Profile › Terms of Use). In the event of a significant change, we will notify you in the app at least 30 days in advance. If you do not accept the new Terms, you may cancel your subscription and delete your account before they take effect.
15. Account Closure and Suspension
At your initiative. You may delete your account at any time in the app (Profile › Delete my account). Your data is then erased, as described in the Privacy Policy. Remember to cancel your subscription in your store.
At our initiative, in case of abuse. We may suspend or close an account in the event of a serious breach of these Terms, in particular:
- automated or large-scale extraction from the Grena database;
- attempted intrusion, or attempts to circumvent limits or security measures;
- fraudulent use of the subscription;
- use that threatens the operation of the service or the security of other users;
- failure to meet the minimum age requirement.
Except in an emergency or a serious breach, we will first notify you by email, stating the reason, and give you a reasonable period to explain or remedy the situation. You may contest the decision by writing to us. Before closure, you may request an export of your data. A paid subscription does not entitle you to a refund if your account is closed due to a serious breach on your part, unless otherwise provided by law.
Inactive guest accounts. A guest account that has never been linked to an email address and has not been used for [90] days is deleted from our servers. The data on your phone is not affected.
16. Liability
Ours. We provide Grena with care. We are liable for any failure to fulfill our obligations, under the conditions set by applicable law. We are not liable for:
- the indicative information in the Grena database (Section 7) and the decisions you make based on it, in particular regarding the purchase, cellaring, tasting, or value of your wines;
- data loss on a guest account, which is not backed up (Section 4);
- interruptions caused by the internet, your device, the stores, or a force majeure event;
- indirect damages, such as loss of opportunity or loss of income, to the extent permitted by law.
These limitations do not apply in the event of gross negligence or intentional misconduct, or bodily injury, nor to the legal guarantees you benefit from as a consumer, in particular the legal guarantee of conformity for digital content and services (Articles L. 224-25-12 et seq. of the French Consumer Code), nor to any other protection that the law of your country does not allow to be excluded.
Yours. You are responsible for your use of Grena, the content you enter, and the security of your phone and your email address.
Alcohol consumption. Grena helps you manage your cellar; it is up to you to drink responsibly and in compliance with the law. Excessive drinking is dangerous to your health.
17. Force Majeure
Neither party is liable for a failure caused by a force majeure event within the meaning of Article 1218 of the French Civil Code: an event beyond its control that could not reasonably have been foreseen and whose effects cannot be avoided (natural disaster, war, pandemic, widespread network or hosting outage, decision by the authorities, etc.). Obligations are suspended for the duration of the event. If it lasts more than 60 days, either party may terminate the contract.
18. Apps Obtained from Apple’s App Store
If you downloaded Grena from the App Store:
- these Terms are concluded between you and Grena, and not with Apple. Grena, not Apple, is solely responsible for the app and its content;
- your right to use the app is limited to Apple devices that you own or control, in accordance with the Usage Rules set out in the Apple Media Services Terms and Conditions;
- Apple has no obligation whatsoever to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price of the app, if any; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever;
- Grena, not Apple, handles any claims relating to the app (product liability, failure to conform to any legal or regulatory requirement, consumer protection, intellectual property);
- you represent that you do not reside in a country subject to a U.S. Government embargo and that you are not on any list of restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
Google Play’s terms apply in the same way if you obtained the app from Google Play.
19. Complaints and Mediation
Complaints. For any complaint, write to us at [email address] or at [postal address]. We acknowledge receipt within 7 days and respond within 30 days.
Consumer mediation. If you are a consumer and your written complaint has not been resolved, you may refer the matter, free of charge, to the consumer mediator with which we are registered: [mediator’s name, address, website] (Articles L. 612-1 et seq. of the French Consumer Code), within one year of your written complaint.
Payments. Complaints about a payment or a refund are handled by Apple or Google (Section 11.6).
20. Governing Law and Jurisdiction
These Terms are governed by French law.
If you are a consumer residing in another country, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence (Rome I Regulation, Article 6, and equivalent rules, for example in Quebec or Switzerland).
In the event of a dispute, and after an attempt to reach an amicable solution:
- if you are a consumer, you may bring the matter before the court of the place where you resided at the time the contract was concluded or the harmful event occurred, or the court of our registered office; within the European Union, the court of your place of residence always has jurisdiction;
- otherwise, the courts of [city of registered office] have exclusive jurisdiction.
21. General Provisions
- Language. These Terms are written in French. In the event of a translation, the French version prevails, unless a mandatory provision of your country provides otherwise.
- Severability. If any clause is held void or unenforceable, the remaining clauses remain in effect.
- No waiver. Failure to invoke a breach does not constitute a waiver of the right to invoke it later.
- Assignment. We may transfer these Terms to a company that takes over Grena, informing you accordingly, without reducing your rights.
- Evidence. The records in our systems and those of the stores constitute proof of purchases and of actions carried out from your account, unless proven otherwise.
